Before Departing Checklist

Before tour departing, payment must be fulfilled, a safety checklist completed, a vehicle inspection completed, overnight equipment and supplies verified, Terms & Conditions agreed with, understood and signed, and a Liability Waiver signed.

Calabogie Off-Road Tours


(This is a legally binding contract. Read completely before signing and initialling.)

This agreement made on the above date by and between Calabogie Off-Road Tours, hereafter referred to as (CORT) and participant hereafter referred to as participant or client.

For and in consideration of the mutual covenants and conditions set forth below, the parties made the agreements, waivers and releases all as set forth below.

Section 1 Tours:

  1. CORT agrees to provide the tour to the participant and provide the necessary vehicles suitable and capable to give the tour. The participant is responsible for their lodging arrangements.

Section 2 Attire:

  1. Rural Ontario is a vast region consisting of a range of topography, geography and weather conditions. Therefore, the participant is responsible for furnishing and wearing appropriate attire to accommodate any weather conditions. Suggested attire includes long pants, hiking shoes, rain gear, a jacket or coat. Open-toed shoes are not allowed.

Section 3 Health/Medical Condition:

  1. The participant must disclose to CORT any health and medical conditions before the tour. CORT reserves the right to terminate or suspend the participation of the participants where such health or medical conditions present an unreasonable greater risk of further injury or where further participation would disrupt the tour or require additional supervision or care by CORT. In addition, CORT may accept a participant’s tour participation upon receipt of a doctor’s release.

Section 4 Non-participation:

  1. Each participant and parent/guardian, where applicable, understand and agree that the participant shall not participate in any activity where the participant is not physically or mentally able to participate without an unreasonable greater risk of injury and shall notify CORT of any condition promptly.

Section 5 Minors:

  1. Parents/Guardians will be responsible for minor children at all times. Parent/guardian warrants and acknowledge that any minor in their care will wear appropriate safety gear at all times, such as seatbelts. The parent/guardian shall be solely responsible for making sure that the minor shall abide by the rules of this contract. Parents or guardians who do not abide by the conditions of this contract will be asked to leave the tour without a refund.

Section 6 Flora, Fauna, Reptiles and Insects:

  1. The participant and parent/guardian acknowledge that a diverse variety of flora, fauna, reptiles and insect life exist in the region, some or all of which may not be familiar to the participant: the utmost care, caution and respect is required as insects pose a risk of cuts, scrapes, bites, stings, odours, sense and other hazards which may pose a risk of injury or possible death.

Section 7 Prohibited Substances:

  1. All tours forbid the use of alcohol, marijuana and any non-prescription medications by the participant. Should this be ignored, CORT reserves the right to terminate or suspend the participant’s tour without a refund.

Section 8 Personal Property:

  1. The participant shall be responsible for all personal property brought by them on tour. CORT, its agents, employees and owners are not responsible for any lost, stolen or damaged property.

Section 9 Warranty of Responsibilities:

  1. Parents and guardians warrant they are legally responsible for the minor, of which they are the primary caretakers. The signature of either parent or guardian shall be sufficient to bind them both to this agreement. The parent or guardian signing this agreement warrants the same for and on behalf of both parents or guardians. Parents/guardians agree each will comply with and be bound by the provision set forth. The guardian warrants having court authorization within the appropriate jurisdiction and agree to produce a certified copy of letters of guardianship if requested.

Section 10 Emergency Attention:

  1. In the event of any injury to a participant, CORT will attempt to contact a parent or guardian if a minor, healthcare provider, doctor or other healthcare provider or emergency medical team or persons, as circumstances may dictate. The participant and parent/guardian shall pay all such emergency medical services whether or not covered by insurance.

Section 11 Alteration:

  1. CORT reserves the right to withdraw, cancel or alter any tour or service as necessary. Further, CORT reserves the right to refuse services to any person at any time, in CORT’s absolute and sole discretion, if deemed to be the appropriate action.

Section 12 Entire Agreement:

  1. No representations or warranties are expressed or implied, except those specifically and expressly set forth in this agreement. This is the entire agreement between the parties and supersedes and cancels all prior negotiations, representations, understanding or agreements made, assumed or knowledge between them. No oral arrangements are modifying or affecting the performance of this agreement. This agreement cannot be changed, altered, modified or amended, except in writing signed by all parties. Paragraph headings do not limit the scope or meaning of the said paragraph and are for ease of reference only. Reference made to the singular includes the plural, and references to one gender include all other genders, when applicable or as the context requires. If a court finds any provision of this agreement unenforceable as a matter of law, the remainder of the agreement shall remain in force to the fullest extent permissible by law.

Section 13 Legal Action:

  1. Legal action commenced under this agreement shall take place in the province of Ontario. The prevailing party to any such legal action shall be entitled to cost and attorney fees against the losing party.

Liability Waiver Agreement


Participant Agreement, Release and Assumption of Risk

In consideration of the services of Calabogie Off-Road Tours LTD., their agents, owners, officers, volunteers, employees and all other persons or entities acting in any capacity on their behalf hereafter collectively referred to as “Released Parties,”  I agree to release, indemnify and discharge Released Parties on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate as follows:

  1. I acknowledge that my participation in any off-road tour provided by Calabogie Off-Road Tours Ltd., entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death or damage to me and my property or to third parties. I understand that such risk cannot be eliminated without jeopardizing the essential qualities of the activity.

The risks include, among other things: slips and falls; the possibility of rough terrain; passages can be jolted, jarred, bounced, thrown about and otherwise shaking during rides; It is possible that riders could be injured if they come into contact with other passengers or equipment; Injuries can be sustained from the trail, equipment or from items on the trail such as holes, bumps, ruts, obstacles, tree limbs and branches or rocks; Major injuries are a risk as are bruises and sprains; musculoskeletal injuries include head, neck and back injuries; Injuries to internal organs, loss of fingers or other appendages, exhaustion; Exposure to elements of outdoor and natural surroundings which of course cause hypothermia, heat exhaustion, sunburn, dehydration and exposure to potentially dangerous wild animals, insect bites and hazardous plant life; The negligence of other participants or persons who may be present; Further passengers can be thrown off the vehicles which can result in any of the above events occurring; accidents involving other vehicles, collisions with fixed or moveable objects; Collisions, and flipping over; Travelling to and from activity locations raises the possibility of any manner of transportation accident; Transmissible pathogens or disease; Accidents or illness can occur in remote places without medical facilities and emergency treatment or other services rendered; The vehicle itself may fail and accidents can happen getting in or out.

Furthermore, Released Parties personnel have difficult jobs to perform. They seek safety, but they are not infallible. They might be unaware of a participant’s fitness or abilities. They might miss judge the weather or other environmental conditions. They may give incomplete warnings or instructions, and the equipment being used might malfunction.

  1. I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate despite the risks.
  2. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Released Parties from any and all claims, demands or causes of action which are not anywhere connected with my participation in the activity or my use of the Released Parties equipment or facilities, including any such claims which alleged negligent acts or omissions of Released Parties.
  3. Should Released Parties or anyone acting on their behalf be required to incur attorney’s fees and cost to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.
  4. I certified that I have adequate insurance to cover any injury or damage I may have caused or suffered while participating. Otherwise, I agreed to bear the cost of such injury or damage myself. I further certified that I am willing to assume the risk of any medical or physical condition I may have.
  5. I am of legal age, being 19 years of age or over.
  6. I have a valid driver’s license in the province or state where it was issued.
  7. I accept full responsibility for any passengers related or unrelated to me by marriage under my charge.
  8. In the event that I file a lawsuit against Released Parties, I agreed to do so solely in the Province of Ontario, and I further agree that the substantive law of the province of Ontario shall apply in the action without regard to the conflict of law rules of the province. Finally, I agree that if any portion of this agreement is found to be void or unforeseeable, the remaining document shall remain in full force and effect.

By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against Released Parties on the basis of any claim from which I have released them herein. I have had sufficient opportunity to read this entire document. I have read and understood it all, and I agree to be bound by its terms.

The parties acknowledge and agree that this waiver form may be executed by an electronic signature which shall be considered as an original signature. Electronic signature includes fax, scanned and emailed versions.

Tim Nadeau

2018 Toyota 4Runner TRD Off-Road

I first fell in love with Off-Roading while raising horses in British Columbia. After many years absent from the sport, I rediscovered my passion after purchasing the 4Runner. In the last three and half years, I have logged countless miles in the bush, made many super cool new friends and modified my 4Runner beyond what I had ever imagined. You can find me on the trails 3 or 4 times a week, logging as much as 25 to 30 hours a week behind the wheel.

I first started wheeling when I was a kid on four-wheelers and dirt bikes. You might say I was raised on the trails. I recently got into the world of modified 4×4 trucks in the last couple of years, which got me modifying my Nissan. I enjoy all runs, from fun and easy right up to the hardcore, nitty-gritty trails. I most enjoy meeting new people and discovering new trails. I’ve spent a lot of time making recoveries, and I am always up for a challenge. I am also a member in good standing with OF4WD. So get muddy and stay flexed.

Syl and Jen have known each other since childhood. Their love for the outdoors leads them to marry and start a family eventually. The Goudreault’s are avid hunters, fishermen and love the outdoor lifestyle so much they bought a campsite. Their friendly family approach to operating their Calabogie Campground & RV Park and living the outdoor life has led to a new love, the discovery of off-roading! Syl and Jen bought their first Jeep, a Rubicon, five years ago. Today Syl drives a 2021 Jeep Rubicon GT, and Jen runs a 2020 Jeep Rubicon Wrangler JL. Both Jeeps are modified to take on some of Calabogie’s most challenging trails. Join Syl and Jen for a family-friendly day exploring the trails or a weekend adventure!
